Terms and Conditions

General Provisions

These terms and conditions ("Agreement") apply to all travel bookings and related services provided by Platform934 (Pty) Ltd. ("Travel Agency") to its customers ("Customers"). By booking travel or related services with Travel Agency, the Customer agrees to be bound by these terms and conditions.

 

Travel Bookings

Travel Agency acts as an agent for airlines, hotels, car rental companies, and other travel suppliers ("Suppliers"). All bookings are subject to the terms and conditions and limitations of liability of the Suppliers. Travel Agency does not guarantee the availability or price of any travel booking, and all bookings are subject to change and availability. In the event that a booking is not available, Travel Agency will use its best efforts to find a suitable alternative, but will not be liable for any damages or expenses resulting from the unavailability of a booking.

 

Travel Insurance

We strongly recommend that Clients purchase travel insurance to protect against unforeseen events such as trip cancellations, medical emergencies, and lost luggage. Clients are responsible for obtaining and paying for their own travel insurance.

Payment and Cancellation Policies

All bookings are subject to payment and cancellation policies of the Suppliers. Customers are responsible for reading and understanding the payment and cancellation policies of each booking before making a reservation. Travel Agency reserves the right to charge fees for its services, including but not limited to booking fees, processing fees, and cancellation fees. Fees are non-refundable, except as required by law.

 

Changes and Cancellations

Travel Agency reserves the right to cancel any booking or service at any time for any reason, including but not limited to changes in travel regulations, political instability, or natural disasters. In the event of a cancellation by Travel Agency, Customers will be refunded any payments made for the canceled booking, less any fees or expenses incurred by Travel Agency. Customers may cancel or change a booking subject to the payment and cancellation policies of the Suppliers. Travel Agency will not be liable for any damages or expenses resulting from changes or cancellations made by Customers. In the event of a cancellation or change of travel plans, Clients may be subject to additional fees and charges imposed by the relevant travel service provider. We are not responsible for these fees and charges and cannot guarantee their amount or frequency.

Liability and Indemnification

Travel Agency is not liable for any damages or expenses resulting from any act or omission of a Supplier, including but not limited to flight delays or cancellations, hotel overbooking, or car rental issues. Customers agree to indemnify and hold harmless Travel Agency, its officers, directors, employees, and agents from any claims, damages, or expenses arising from the Customer's use of Travel Agency's services or the Customer's breach of these terms and conditions.

 

Force Majeure

We are not liable for any failure or delay in the performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of terrorism, and government actions.

 

Disclaimer of Warranties

Travel Agency provides its services "as is" and without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

 

Intellectual Property

Our website and all content, trademarks, and logos are owned by us or our licensors. Clients are not authorized to use or reproduce any content or intellectual property without our prior written consent.

 

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa. The language of the arbitration shall be English, and the arbitration shall take place in Johannesburg, South Africa.

 

Amendments and Termination

Travel Agency reserves the right to amend or terminate this Agreement at any time without notice. Customers are responsible for reviewing these terms and conditions periodically.

 

Entire Agreement

This Agreement constitutes the entire agreement between Travel Agency and the Customer and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement.
